1. Introduction

These Terms of Service ("Terms") govern your access to and use of Diceroll, the website and application located at diceroll.ai (the "Service"). The Service is operated by Oxyai ("Oxyai", "we", "our", or "us").

By accessing or using the Service, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.

Our Privacy Policy explains how we collect, use, and share personal data. Our Refund & Cancellation Policy explains how subscription cancellation and refund requests are handled.

Oxyai is established in Finland. Application data is processed on servers in Germany as described in the Privacy Policy.

3. The Service

Diceroll is a single-player, AI-driven tabletop role-playing game. You create and play campaigns through a chat interface where an AI system acts as a dungeon master and generates fictional narration, game events, and related content.

The Service is provided for entertainment. It is not designed to provide legal, medical, financial, professional, or other advice.

4. Communications

We may send you service, account, security, billing, and other transactional emails that are necessary to provide the Service.

We will send marketing communications only where we have a lawful basis to do so, such as your consent where consent is required. You can opt out of marketing communications by using the unsubscribe link in the message or by contacting us at contact@diceroll.ai.

5. Eligibility and accounts

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the authority to enter into these Terms.

Accounts are created using Google OAuth, GitHub OAuth, or a passwordless email magic-link sign-in flow. The Service does not provide public usernames or user-set passwords. You are responsible for maintaining access to your email account and third-party sign-in providers and for promptly telling us if you suspect unauthorized access to your account.

You must provide accurate account and billing information and keep it up to date. We may suspend or terminate accounts that violate these Terms, abuse the Service, create security risk, or are used for unlawful activity.

6. Purchases and payment processing

Diceroll sells access to digital subscription plans. No physical goods are sold through the Service, and we do not ask for shipping information.

Subscription checkout and billing are handled by Creem, our third-party payment processor. We do not store or collect your payment card number, card expiration date, or card security code. You provide payment details directly to Creem, and Creem processes those details under its own terms and privacy policy.

You represent that you are authorized to use the payment method used for a purchase and that the billing information you provide is accurate and complete. We may refuse or cancel a purchase where fraud, an unauthorized transaction, a pricing error, or another lawful reason is suspected.

7. Subscription plans, credits, and billing

Diceroll offers Free, Lite, Pro, and Max tiers. Paid plans may be billed monthly or yearly through Creem. The available tiers, prices, billing periods, and included allowances are shown at checkout and on the Service's Plans & Billing page.

Each tier grants a monthly AI-credit allowance. AI credits are a usage unit for metering AI activity in the Service. AI actions such as dungeon-master turns, NPC dialogue, battles, scenario generation, descriptions, and similar features consume credits based on the cost of the AI work performed.

Credits have no cash value, are not refundable, are not transferable, and cannot be exchanged for money or other value. Unused credits do not roll over. Paid-plan allowances reset each billing period, and the Free tier allowance resets each calendar month in UTC.

Paid subscriptions renew automatically at the end of each billing period unless cancelled. You can upgrade, downgrade, cancel, resume, update payment methods, and view invoices through the Plans & Billing page and the Creem customer portal.

If a subscription payment fails, we may suspend paid-plan access, downgrade your account to the Free tier, or terminate the subscription after reasonable attempts to process payment.

We may change subscription fees or plan allowances. If a change affects your existing paid subscription, we will provide reasonable advance notice where required and give you an opportunity to cancel before the change takes effect.

8. Refunds and cancellation

Subscription purchases are purchases of digital access that begins immediately after checkout. Except where required by mandatory applicable law or expressly stated in our Refund & Cancellation Policy, subscription fees are non-refundable and we do not provide partial refunds or credits for unused time, unused credits, downgrades, or cancelled subscriptions.

Cancelling a paid subscription stops future renewal charges. Unless the Refund & Cancellation Policy or mandatory law says otherwise, you will continue to have access to the paid tier until the end of the current paid billing period.

9. Your content

"Your Content" means content you submit to or create in the Service, including campaign messages, character details, custom scenario text, uploaded images, and other game information you provide.

Diceroll is a single-player product. Your Content is not published to other users by default, and these Terms do not grant other Diceroll users a right to use Your Content.

You retain your rights in Your Content. You grant Oxyai a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify for technical formatting, transmit to service providers, and display Your Content back to you as needed to operate, secure, support, and improve the Service and to generate AI responses for your gameplay.

You are responsible for Your Content and must have the rights needed to submit it to the Service. You must not submit content that is unlawful, infringes another person's rights, or violates these Terms.

10. AI-generated content and LLM processing

The Service uses third-party large language model providers to generate dungeon-master responses and other game content. As you use the game, text and other content relevant to the current AI task may be sent to an LLM provider, including campaign messages, character details, party/inventory/world/lore state, generated summaries, and uploaded images where applicable.

AI-generated output may be inaccurate, incomplete, offensive, inconsistent, unexpected, or unsuitable for your intended use. It is fictional entertainment content, not advice. You are responsible for reviewing and deciding how to use or rely on AI-generated output.

Oxyai does not claim ownership of AI-generated output generated specifically for your account. To the extent Oxyai has rights in that output, Oxyai grants you a non-exclusive right to use it as part of your personal gameplay and related personal, non-commercial uses. Oxyai does not guarantee that AI-generated output is unique, protectable by intellectual-property law, or free from similar output generated for others.

You must not use the Service or AI-generated output to generate illegal content, infringing content, malware, instructions for wrongdoing, or content that violates another person's rights. You must not attempt to extract hidden prompts or system instructions, bypass safety or usage limits, interfere with metering, reverse engineer the Service, or use the Service or bulk outputs to build or train a competing AI model without our written permission.

11. Prohibited uses

You agree not to use the Service:

  1. in any way that violates applicable law or regulation;
  2. to exploit, harm, threaten, harass, or attempt to exploit or harm any person;
  3. to infringe or misappropriate intellectual-property, privacy, publicity, contractual, or other rights;
  4. to send spam, unsolicited promotions, chain letters, or similar messages;
  5. to impersonate Oxyai, another user, or any other person or entity;
  6. to introduce malware, harmful code, or other technologically harmful material;
  7. to disable, overburden, damage, disrupt, scrape, crawl, or interfere with the Service or connected systems;
  8. to attempt unauthorized access to any account, server, computer, database, or non-public part of the Service;
  9. to attack the Service through denial-of-service attacks or similar activity;
  10. to evade usage limits, credit metering, billing, security controls, or other Service restrictions; or
  11. in any other way that may harm Oxyai, the Service, or others.

12. Analytics

We use PostHog, hosted in the European Union, to monitor and analyze Service usage, capture errors, and collect application logs. The Privacy Policy explains this processing in more detail.

13. Intellectual property

The Service, including its software, design, features, branding, and original content other than Your Content, is owned by Oxyai or its licensors and is protected by copyright, trademark, and other laws of Finland and foreign countries.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as allowed by these Terms or mandatory applicable law.

If you believe content in the Service infringes your intellectual property rights, contact us at contact@diceroll.ai with enough detail for us to understand and assess the claim.

14. Feedback

If you send us feedback, ideas, suggestions, or bug reports, you grant Oxyai a non-exclusive, worldwide, royalty-free, transferable, and sublicensable right to use them for any purpose without compensation to you. This does not affect your rights in Your Content.

15. Links to other websites and services

The Service may contain links to third-party websites or services that are not owned or controlled by Oxyai. We are not responsible for their content, policies, or practices. You should review the terms and privacy policies of any third-party service you use.

16. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Oxyai disclaims warranties and representations, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service or AI-generated output will be uninterrupted, secure, error-free, accurate, complete, or suitable for your expectations or intended use.

Nothing in these Terms limits any warranty, consumer guarantee, or other mandatory right that cannot be excluded or limited under applicable consumer law.

17. Limitation of liability

To the maximum extent permitted by applicable law, Oxyai is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill arising out of or related to the Service or these Terms.

To the maximum extent permitted by applicable law, Oxyai's total aggregate liability arising out of or related to the Service or these Terms is limited to the greater of the amount you paid to Oxyai for the Service during the 12 months before the event giving rise to the claim or EUR 100.

These limitations do not exclude or limit liability for intentional misconduct, gross negligence, fraud, death or personal injury caused by negligence, or any liability that cannot be excluded or limited under mandatory applicable law. If you are a consumer in the European Union or European Economic Area, these limitations apply only to the extent permitted by your mandatory consumer rights.

18. Indemnity

To the extent permitted by applicable law, you agree to compensate Oxyai for losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Service, your breach of these Terms, or Your Content infringing another person's rights. If you are a consumer, this section applies only to the extent permitted by mandatory consumer law.

19. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, fail to pay amounts owed, create legal or security risk, or use the Service in a way that may harm Oxyai, the Service, or others.

You may stop using the Service at any time. Subscription cancellation is handled as described in section 8 and the Refund & Cancellation Policy.

Sections that by their nature should survive termination will survive, including sections about payments owed, Your Content licenses already needed to operate or secure the Service, intellectual property, disclaimers, liability limits, indemnity, and governing law.

20. Governing law and disputes

These Terms are governed by the laws of Finland, without regard to conflict-of-law rules.

The competent courts of Finland have jurisdiction over disputes arising from or related to these Terms or the Service. If you are a consumer in the European Union or European Economic Area, you may also have the right to bring proceedings in the courts of your country of residence and to rely on mandatory consumer protections under the laws of your country of residence.

21. Changes to the Service and these Terms

We may update, suspend, withdraw, or change the Service from time to time. We may also amend these Terms by posting the updated version on this page. Where required, we will provide reasonable notice of material changes.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to updated Terms, you must stop using the Service and cancel any paid subscription before the changes take effect.

22. General terms

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

These Terms, together with the Privacy Policy and Refund & Cancellation Policy, form the agreement between you and Oxyai for the Service.
